These General Terms and Conditions apply to all contracts between Crelvo, Konrad Reyhe, c/o MDC Management#6099, Welserstraße 3, 87463 Dietmannsried (hereinafter "Provider") and the customer regarding the use of the service "Headshot AI" at the domain bewerbungsfotos-ai.de.
The Provider offers an online service that uses artificial intelligence to create professional headshots from selfies uploaded by the customer. The exact scope of services is determined by the chosen package (Starter, Professional or Executive).
1. The presentation of packages on the website does not constitute a legally binding offer, but a non-binding invitation to order. 2. The customer submits a binding purchase offer by completing the order process and making payment. 3. The contract is concluded upon payment confirmation by the payment service provider (Stripe).
1. All prices stated are final prices. Due to the small business exemption pursuant to § 19 UStG (German VAT Act), no VAT is charged and therefore not shown. 2. Payment is made once before service delivery via the payment service provider Stripe. No recurring costs apply. 3. Accepted payment methods: credit card, debit card, Apple Pay, Google Pay and other methods supported by Stripe.
1. After receipt of payment, automated creation of the headshots begins. 2. Processing time is usually 10–20 minutes, depending on the chosen package. 3. The customer will be notified by email as soon as the photos are ready for download. 4. The generated photos are available for download for the period specified in the package (30–90 days).
1. The customer receives a simple, time-unlimited right of use for the generated headshots for private and commercial purposes (job applications, LinkedIn, XING, websites, etc.). 2. Passing on the photos to third parties for commercial exploitation is not permitted. 3. The uploaded original photos remain the property of the customer.
1. AI-generated images may in individual cases contain artefacts or inaccuracies. The Provider does not guarantee that every individual generated photo will meet the customer's expectations. 2. The Provider is liable for intent and gross negligence. In cases of slight negligence, the Provider is only liable for breach of material contractual obligations, limited to foreseeable, contract-typical damage. 3. Liability is limited to the order value.
If the customer is not satisfied with the results, they may request a full refund within 14 days of the photos being made available. The refund will be made via the original payment method.
The processing of personal data is carried out in accordance with our Privacy Policy. Uploaded photos are automatically deleted after processing. Generated photos are deleted after the period specified in the package.
1. The law of the Federal Republic of Germany applies. 2. Place of jurisdiction is Leipzig, to the extent permitted by law. 3. The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr.
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
4. Should individual provisions of these T&Cs be invalid, the validity of the remaining provisions shall remain unaffected.
